Terms Of Service
1. General
Date of GTC: 26.03.2026
1.1. These General Terms and Conditions („GTC“) apply to orders, sales, and deliveries of products („Products“) offered and sold in this online shop („Online Shop“) via the website www.lifeundying.com.
1.2. The contract language is english.
2. Scope of Application
2.1. These GTC are applicable when the buyer is a consumer within the meaning of § 1 of the Austrian Consumer Protection Act (Konsumentenschutzgesetz, „KSchG“) („Customer“).
3. Amendments to the GTC
3.1. The provider reserves the right to amend these GTC. The GTC valid at the time of purchase shall apply to the sale of Products.
4. Customer Account
4.1. To order Products, the Customer may create a customer account in the Online Shop. The creation of the customer account requires the provision of certain information by the Customer.
Ordering is also possible without a customer account.
5. Order, Order Confirmation, Shipping Confirmation
5.1. The ordering process consists of the following steps:
- Selection of the desired goods
- Placing the goods in the shopping cart
- Entry of personal data
- Selection of payment method and delivery method
- Final review and, if necessary, correction of the order
- Binding submission of the order by clicking „Order with obligation to pay“
5.2. The Products and prices displayed in the Online Shop constitute an invitation for the Customer to submit a binding offer to purchase Products from the provider („Order“). By clicking the button labelled „Order with obligation to pay,“ or an equivalent formulation, the Customer submits a binding Order to the provider. Illustrations and drawings of the goods are considered approximate values only, unless expressly indicated as fixed values for the product. The Customer accepts minor and objectively justified deviations.
5.3. The provider will promptly send the Customer an acknowledgment to the email address provided by the Customer, confirming that the Order has been received by the provider („Order Confirmation“). This Order Confirmation does not constitute acceptance of the Customer’s Order, but merely confirms receipt of the Order by the provider.
5.4. Acceptance occurs at different times and in different forms depending on the chosen payment method:
- By sending an order confirmation via email, whereby the time of receipt of the order confirmation by the Customer is decisive.
- By shipping the ordered goods to the Customer, whereby a shipping confirmation sent shall be understood as an order confirmation. If no separate shipping confirmation is sent to the Customer, the time of receipt of the goods by the Customer is decisive.
- By sending a payment request.
5.5. The Customer must ensure that all information provided in connection with an Order, in particular the data required for shipping, is accurate, correct, and up to date. The Customer must notify the provider of any changes to this information without delay.
5.6. After conclusion of the contract, the provider will send the Customer an electronic invoice. The Customer agrees to receive an electronic invoice.
6. Payment Terms
6.1. All prices are stated in euros, including value-added tax (VAT), but excluding shipping costs, unless otherwise indicated. Shipping costs are displayed to the Customer before the Order is placed.
6.2. Payment in the Online Shop can be made via the following payment methods: credit card, instant bank transfer (Sofortüberweisung), PayPal.
6.3. Shipping costs are order-dependent and will be displayed by the provider before the Order and in the Order Confirmation.
7. Delivery
7.1. The Customer may choose from the shipping methods offered by the provider in the Online Shop.
7.2. The delivery dates stated by the provider are based on the information provided by the commissioned shipping service provider. Unless a different delivery date is specified for the respective Products, the delivery period shall not exceed 30 days from the conclusion of the contract.
7.3. If non-compliance with the delivery date is due to force majeure, industrial disputes, or other events beyond the provider’s control, the delivery date shall be extended appropriately for the duration of the impediment. The provider will notify the Customer of the beginning and end of such circumstances as soon as possible, without the Customer being able to derive any claims from the failure to provide such notification.
7.4. If the Customer is in default of acceptance of the Products, the warranty period for the provider’s performance shall begin to run.
8. Retention of Title
8.1. The provider retains ownership of the Products until full payment of the purchase price and ancillary costs (in particular shipping costs) by the Customer.
9. Provider’s Default
9.1. If the provider is in default of performance, the Customer must first request the provider to perform within a reasonable grace period of two weeks. If the provider fails to perform within this period, the Customer may withdraw from the contract or continue to demand performance.
10. Warranty
10.1. Lukas Maier EPU provides warranty in accordance with the statutory provisions. For complaints, please contact contact@lifeundying.com.
10.2. The provider may require the Customer, if it is reasonable for the Customer, to send the defective Products to the provider, whereby the provider shall bear the risk of shipment and the costs of return. The Customer is requested to report goods delivered with obvious transport damage to the delivery service and to inform the provider thereof. If the Customer fails to do so, this shall have no effect on the Customer’s warranty claims.
11. Liability and Damages
11.1. The provider’s liability for slightly negligently caused damages, except for personal injury and contractual primary obligations, is excluded. Liability is furthermore excluded for pure financial losses, loss of profits, third-party damages, indirect damages, and consequential damages arising from defects. The liability-limiting or liability-excluding provisions of this Section 11 shall not apply if and to the extent that the provider acted with gross negligence or intent.
12. General Provisions
12.1. Unless Austrian law is already applicable due to the orientation of this Online Shop towards Austria, the exclusive applicability of Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), is agreed.
12.2. For consumers, this choice of law shall only apply insofar as the protection granted by mandatory provisions of the law of the state in which the consumer has their habitual residence is not withdrawn.
12.3. The Customer may only offset claims against the provider’s claims if the claims are legally related to the provider’s claims, have been acknowledged, or have been established by a court.
12.4. The Customer is obliged to notify the provider of any changes to their address. If the Customer fails to notify a change of address, any declaration sent by the provider to the last known address shall be deemed to have been received.
Right of Withdrawal
Right of Withdrawal / Right of Cancellation
The Austrian term „Rücktrittsrecht“ (right of withdrawal) corresponds to the German term „Widerrufsrecht“ (right of cancellation) used in the Consumer Rights Directive. We therefore use the equivalent pair of terms „Right of Cancellation (Right of Withdrawal).“ In this withdrawal notice, only the term „Right of Cancellation“ is used. This is equivalent to the Austrian term „Right of Withdrawal.“
Non-Existing Right of Cancellation (Right of Withdrawal)
There is no right of cancellation (right of withdrawal) for goods that are made to the customer’s specifications or are clearly tailored to personal needs.
There is no right of cancellation (right of withdrawal) for goods that can spoil quickly or whose expiry date would be exceeded quickly.
There is no right of cancellation (right of withdrawal) for newspapers, magazines, or periodicals (with the exception of subscription contracts).
Lapsing Right of Cancellation (Right of Withdrawal)
For goods that are delivered sealed and are not suitable for return for reasons of health protection or hygiene, the right of cancellation (right of withdrawal) lapses if the goods have been unsealed after delivery.
For audio or video recordings such as CDs, DVDs, etc., as well as computer software delivered in sealed packaging, the right of cancellation (right of withdrawal) lapses if the goods have been unsealed after delivery.
For goods that have been inseparably mixed with other goods after delivery due to their nature, the right of cancellation (right of withdrawal) lapses.
Right of Cancellation
You have the right to cancel this contract within fourteen days without giving any reason.
The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods.
To exercise your right of cancellation, you must inform us:
Lukas Maier EPUÂ 8045 Graz Tel.: +436761234567 Email:Â contact@lifeundying.com
by means of a clear declaration (e.g. a letter sent by post or email) of your decision to cancel this contract. You may use the attached model cancellation form for this purpose, but it is not mandatory.
To meet the cancellation deadline, it is sufficient that you send the notification of the exercise of the right of cancellation before the cancellation period expires.
Consequences of Cancellation
If you cancel this contract, we shall reimburse all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choosing a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we received the notification of your cancellation of this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees for this reimbursement.
We may withhold the reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
You must return the goods to us or hand them over without undue delay and in any event no later than fourteen days from the day on which you inform us of the cancellation of this contract, to:
Lukas Maier EPUÂ 8045 Graz
The deadline is met if you send the goods before the fourteen-day period expires.
You shall bear the direct costs of returning the goods.
You shall only be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
